Terms and conditions

[NEEDS HUMAN SIGN-OFF]

This is a first draft written for Snagwise. It has not been reviewed by a solicitor and must not go live in this state. Payment terms are now settled (clause 7), but clause 6 still needs a cancellation figure, and clauses 7 and 9 both raise consumer-law questions that need a solicitor rather than a copywriter.

Last updated: [NEEDS HARRY: date on sign-off]

1. Who we are

Snagwise provides independent snagging surveys of new build residential property. [NEEDS HARRY: Trading name, legal entity and company number if incorporated. Needed for the footer, Terms, Privacy and the schema graph.]

2. What we provide

A non-invasive visual inspection of the property and a written report recording the defects and workmanship issues visible at the time of the inspection, with photographs. The report is prepared for you and is for your own use. You may share it with your developer, housebuilder or warranty provider.

3. What we do not provide

Our inspection does not include, and our report does not comment on:

  • the structure of the building, its foundations, or any structural movement;
  • the condition or performance of electrical, gas, heating, water or drainage systems;
  • anything concealed, including beneath floor coverings, behind panels or within voids;
  • the market value of the property or its suitability for lending purposes;
  • compliance with Building Regulations, planning permission or warranty standards.

This is not a structural survey, a RICS Home Survey, a valuation, or a Pre-Completion Inspection under the New Homes Quality Code unless we have agreed that in writing.

4. Booking

A booking is confirmed when we have agreed a date with you in writing. We will tell you the price before you book, and that price will not change afterwards unless the property turns out to be materially different from what you described.

5. Access

You are responsible for arranging access to the property at the agreed time. If we cannot gain access and you have not told us in advance, we may treat the appointment as a late cancellation under clause 6.

6. Changing or cancelling

You may reschedule free of charge with at least 24 hours’ notice. [NEEDS HARRY: state what happens to the 50% deposit on a late cancellation, and on a cancellation you make before we attend at all. A term saying a fee “may apply” without a figure is not enforceable, and now that a deposit is taken this clause is the one a customer will actually read.]

[NEEDS HARRY: One decision left: whether a booking can move free of charge when the completion date slips. Payment terms are settled (50/50, confirmed 15 October 2026). New build dates slip constantly and a competitor already offers free rescheduling, so this is the remaining soft spot. Switched off in POLICY.movableBooking until agreed.]

7. Payment

A deposit of 50% of the agreed price is payable to secure your booking. The remaining 50% falls due once the inspection is complete and your report has been issued to you.

[NEEDS HUMAN SIGN-OFF: taking a deposit before the service is performed engages the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. A consumer booking at a distance generally has 14 days to cancel, and if they want the inspection inside that window they must be asked to agree expressly to it starting early and told they may owe a proportionate amount if they then cancel. Clause 6 needs to carry that wording, and the booking form needs to capture that agreement. This is a solicitor question, not a copy question, and we have deliberately not drafted it.]

8. Your report

We will issue your report within 48 hours of the inspection. The report reflects what was visible on the day. We cannot be responsible for defects that were concealed, that were not visible at the time, or that arise after our visit.

The report is yours to use and to share. We retain copyright in it, and it may not be republished commercially or presented as the work of anyone else.

9. Our liability

[NEEDS HUMAN SIGN-OFF: this clause needs a solicitor. A blanket cap at the fee paid is common in this industry and may be unenforceable against a consumer under the Consumer Rights Act 2015. We have deliberately not drafted a cap here rather than drafting one that does not hold.]

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else which cannot lawfully be limited.

10. Acting on the report

Decisions about your purchase are yours. We report what we found and what we would prioritise; we do not advise you whether to complete, and we do not act as your representative in any dispute with your developer or warranty provider.

11. Complaints

If you are unhappy with anything we have done, tell us and we will try to put it right. [NEEDS HARRY: state how a complaint is made and the timescale for a response.]

12. Governing law

These terms are governed by the law of England and Wales. [NEEDS HUMAN SIGN-OFF]
